The originality of this research lies in the integration of two translations of little-known texts relating to international criminal justice at the time when military tribunals were being set up after World War 2. It allows us to observe how Kelsen's thinking became established but also shows the limits of his normativism on an international scale because the interstate structure did not disappear completely.
