<p>This book sets out to present an aspect of Hans Kelsen's legal thinking and, more particularly, its conception of international law (its evolution and nature). The originality of this research lies in the integration of two translations of little-known texts relating to international criminal justice at the time when military tribunals were being set up after World War 2. It allows us to observe how Kelsen's thinking became established but also shows the limits of his normativism on an international scale because the interstate structure did not disappear completely. It underwent some adjustment, which was based chiefly on the recognition of the individual as litigant.</p>

<p>À l'heure où la Cour pénale internationale se voit critiquée par nombre de ses détracteurs, cet ouvrage propose une analyse de la judiciarisation internationale au prisme de l’un de ses initiateurs : Hans Kelsen. Le théoricien du normativisme a réfléchi sur le droit international, notamment lors de son exil aux États-Unis. Il ne cessera de promouvoir une Organisation des Nations unies dont le pivot serait une juridiction. Tout en permettant de mieux saisir la trajectoire intellectuelle du juriste viennois outre-Atlantique, les études rassemblées ici soulignent les tensions inhérentes à l’établissement des premiers tribunaux militaires après la Seconde Guerre mondiale, qu’elles concernent la reconnaissance d’un individu justiciable ou bien l’application du principe de non-rétroactivité. Fondé notamment sur la présentation et la traduction de textes consacrés à la responsabilité et à la poursuite des criminels de guerre, cet ouvrage rentre en résonance avec les dilemmes contemporains qui entourent l’établissement d’une justice pénale internationale.</p>

<p>Against the background of the International Criminal Court crisis, this book analyses international judicialisation through the lens of one of its originators: Hans Kelsen. The normativism theorist reflected on International Law, particularly during his exile in the United States. He ceaselessly promoted a United Nations Organisation with a tribunal as its linchpin. By providing a new understanding of the intellectual trajectory of the Viennese legal expert, these studies underline the tensions behind the creation of the first military courts after the Second World War, whether they related to the recognition of the individual as a litigant or the application of the principle of non-retroactivity. Through the presentation and translation of texts on the subjects of responsibility and the prosecution of war criminals, this book resonates with the current dilemmas surrounding the institutionalisation of international criminal justice.</p>
